SHRC summons SIT head on July 30
SRINAGAR, July 16: Observing that the state government has not adopted humane approach in favour of next of kins of teenager Wamiq Farooq, the State Human Rights Commission (SHRC) has summoned head of the Special Investigation Team, (SIT) probing the killing of the schoolboy, to appear before it on July 30.

A single bench of SHRC comprising Javaid Kawoosa in the latest order has observed that communication received from Under Secretary to Government (GAD) on July 8 shows that human approach in favour of the next of kins has not been adopted.

“Rather the government has remained adamant to follow legal niceties,” the SHRC said, adding, “The Under Secretary has in his report submitted that the SSP Srinagar on 05-05-2010 has reported that Wamiq Farooq was part of the unlawful assembly and involved in the stone pelting incident which deprive his NoKs from the benefits envisaged …”

The commission said the Under Secretary is stuck to the letter (dated 05-05-2010) “while as since then much water has flown down the Jhelum and competent courts of law are seeking fresh resort of the investigation in the matter.”

“As this communication has not been taken into confidence by the IO of FIR (no. 12/2010) P/s Nowhatta regarding the latest investigation which perhaps is being conducted by a SIT,” the commission said, adding, “So let the Investigating Officer be summoned alongwith C.D file, so that the credibility and authenticity of the letter dated 05-05-2010 of SSP Srinagar can be ascertained at the touchstone of the latest investigation conducted in the case.” The commission has directed to summon the IO to appear on July 30.

Wamiq Farooq was killed on January 31, 2010 when a teargas shell allegedly hit him on the head near Gani Memorial Stadium at Rajouri Kadal in old part of Srinagar.

Soon after Wamiq’s killing, his father, Farooq Ahmad Wani, had filed a complaint before the CJM seeking registration of an FIR under section 302 RPC.

The Chief Judicial Magistrate on February 5, 2011 had directed IGP to constitute SIT which was finally put in place on July 3, 2012.
