Court acquits father in abetment to suicide case

JAMMU, Jun 30(JNF): Principal Sessions Judge Udhampur A K Koul acquitted one Suram Chand son of Premu resident of Baduna Kud, tehsil Chenani, who was facing trial in an abetment to suicide case of his son and daughter-in-law.
According to the police case, on March 9, 2010 a source report was received in police station Kud that Soni Devi and her husband Sohan Lal committed suicide by consuming some poisonous substance for unknown reasons.
On receiving information a case under Section 309 RPC was registered and the investigation was set in motion. The Investigating Officer rushed on spot. The bodies were shifted to first Chenani and then Udhampur hospital for postmortem where after same were handed over to their kin for last rites. Statements of witnesses were recorded and after conclusion of investigation, it came to the fore that accused used to taunt and harass the deceased which forced the deceased to commit suicide on the intervening night of March 8 and 9, 2010. It was concluded by the Investigating Officer that accused had committed offence u/s 306 RPC and accordingly after receiving the expert's opinion he submitted the charge sheet to the court for judicial determination.
Principal Sessions Judge Udhampur A K Koul after hearing advocate Ajay Bandral appearing for the accused and Public Prosecutor Navneet Gupta appearing for the state observed that it was really unfortunate that the deceased died an unnatural death, but the agony was that prosecution had not been able to make out a case against the accused beyond all shadows of doubt.
“The exercise conducted by the investigating agency as well as the prosecution has ended in futility because the nexus between the guilt and accused has not been established as required under law. So the court has no option but to observe that the case is a failure and is accordingly dismissed. Accused is acquitted of the charges leveled against him,” the Principal Sessions Judge held while acquitting the accused.
