Baramulla court rejects bail plea of accused

SRINAGAR, June 29: A local court today rejected the bail application of a person accused of rape attempt on a minor in Baramulla district of north Kashmir. Judicial magistrate (Sub judge) Baramulla, Choudhary Sikandar Azam, after hearing the defense counsel and prosecuting officer, Baramulla courts, Khursheed Ahmad, turned down the bail plea of accused, Imtiyaz Ahmad Parray son of Mohammad Sultan Parray of Kitchhama Baramulla.
On June 14 a complainant lodged a complaint in police station Sheeri that the accused made an attempt to rape her nine-year old daughter, a 3rd standard student while finding her alone.
“Stiff resistance of victim and timely intervention of a passer-by the accused did not succeed in his evil design,” read the complaint.
On receipt of the complaint case FIR number 26 / 2013 under section 376, read with 511 RPC was registered at PS Sheeri and investigations set into motion.
The defense counsel today moved a bail application for accused which was rejected by the court.
Prosecuting officer, Baramulla courts, Khursheed Ahmad representing the state pleaded that the offences in the commission of which accused is involved are grave, heinous and running harshly against larger public interest. “The scars of crime will remain on the mind and soul of innocent minor victim throughout her life and she has been pushed into deep psychological and emotional crisis by the accused and any concession of bail will enable the accused to confront the minor victim day in and day out and may also cause serious impediments in the smooth investigation of the case,” Prosecution further pleaded.
The judge after hearing the counsel for accused and prosecuting officer for the state observed that it transpires that the accused is involved in the commission of offences under section 376, 511 RPC “Keeping in view the stage of the investigation into the case the accused if granted the concession of bail will tamper with prosecution evidence and hamper the investigation thus is not entitled to the same,” the judge observed.
With these observations the judge rejected the application seeking grant of bail in favour of the accused.
