Inmate seeks lodging of FIR against Jail authorities

HC directs DGP Prison to file response, preserve CCTV footage

JAMMU, Sep 14 (JNF): In a petition filed by an inmate, facing trial in murder case, seeking direction to registration of FIR against Jail authorities of Kot Bhalwal who had beaten him mercilessly, High Court today directed Director General of Prisons to file response with the regard to allegations and to preserve the CCTV footage of Central Jail.
After hearing Advocate Kousal Parihar for petitioner, Justice Dhiraj Singh Thakur of J&K High Court Jammu wing issued notice to respondents and directed Director General of Prisons to file response with the regard to allegations made in the petitions. High Court also directed to preserve the CCTV footage of Central Jail.
According to petition, the petitioner is an under trial prisoner in case FIR number 78 of 2015 registered with Police Station Janipur, Jammu under section 302 and 34 of RPC and charge sheet is pending before the First Additional District and Session’s Judge, Jammu. On August 14, 2017, when the petitioner was in his barrack some dispute arose between the Jail authorities and some inmates who were at that time in the common TV Room. During such quarrel there was scuffle between them resulting into loss to property also and then Jail authorities brought some of the inmates who were involved in the destruction of property of jail in TV Room to barrack of the petitioner.
The Jail authorities started beating them and after some time they also started beating the petitioner. They brutally beat up the petitioner without any provocation in which the petitioner received serious injuries over the head, arms and whole of the body which were visible by naked eye and even blood was oozing out of injuries but neither any medicine nor any ointment was given. They beat up the petitioner just like animal and when the petitioner was brought to court for his appearance before First Additional Session Judge, Jammu, the injuries which were received by petitioner at hands of Jail authorities in the jail were shown by the petitioner to Presiding Officer of the court by opening his shirt in open court room.
Presiding Officer of the court is witness of the injuries which the petitioner received at the hands of Jail authorities when the petitioner was in their custody and was produced in the court by respondents. Then it is the Jail authorities only who are responsible for the injuries received by the petitioner.
