JAMMU, Oct 22 (JNF): Court today awarded 22 years Rigorous Imprisonment and fine Rs 30,000 to Pak national, working as Informer.

Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal today awarded 22 years RI and fine Rs 30,000 to Pak National Khalid Pervaz alias Javed Mohammad Ali of Ikhalaspur, district Narobal, Pakistan who was working as Pak army agent.

According to the facts, complainant residence of Bari Baramana and her husband is a police constable. She has kept one tenant Javed of Ludiana, who is working in a factory at Bari Baramana as a labourer. On day of occurrence at 11 AM she was inside her house and was busy in her domestic work, accused having enticed her son, who was playing in Verandah of the house alongwith accused Javed and kidnapped him from there. Despite best efforts, he remained untraceable.

On the basis of this report, police registered the case and started investigation.

Accused was arrested and interceding the investigation the fact emanated are that accused had impersonated his name as Javed, whereas his real name is Khalid Parvez, resident of Pakistan and is PAK national. He is residents of Ikhalaspur, district Narobal, Pakistans. Accused was taken over by police of Pathankot from Railway personnel who was required to be arrested in two cases in FIR number 131 of 2006 under section 420, 468, 467 and 471 IPC and in FIR number 42 of 2006 under section 3/34, 14 F A and 20 Passport Act. Thereafter, evidence of the witnesses was recorded by Inspector Parvez Ahmed. Child was recovered and kept on ‘supardnama’ of Mohammad Din.

Thereafter, on the transfer of Parvez Ahmed investigation was entrusted to ASI Azaz, who seized an amount of Rs 7848 from the office of Western Union Gandhi Nagar and interceding the investigation accused was brought from Punjab by obtaining warrant from the court of JMIC Samba. On the disclosure statement of accused, after interrogation of the accused in JIC Jammu, statement of owner Pacific Cyber Café was recorded and alongwith other witnesses. During investigation, it is revealed that accused was sending information regarding Indian Army through e-male to Pakistan and information was called from General Manager Telecom BSNI and DENB, however, same has not been received because accused has deleted the same.

It is further revealed that accused was employee of Pakistan Police as constable in the year 1997 and a case was registered against him under section 307 and after the commission of offence, accused absconded, thereafter dismissed from service. In the year 2004, accused with the assistance of Major Safdar made a fake passport and entered in the Indian Territory through Waga border in 2005 for seeking information regarding Indian Army. In June, 2006 , accused remained as tenant in Nanak Nagar by impersonating his name as Mohinder and during this period accused was working as agent of Pakistan and regularly sending information through ID – RARMK 24 @ Yahoo.com to Major Safdar in Pakistan though his Mobile number 03006158081.

On the basis of kidnapping of Saqib son of complainant, and sending information about Indian army to Pakistan, case under section 3 EAO and 363 and 368 RPC is proved against the accused. Accordingly, challan under section 3 EAO, and 363 and 368 RPC has been presented against the accused.

Principal Sessions Judge Jammu Jang Bahadur Singh Jamwal after hearing Public Prosecutor Shabir Choudhary appearing for the state whereas Advocate PS Pawar as amicus-curie for the accused observed that since in our state as well as in the country innocent people are suffering from the militancy related activities and number of lives of innocent as well as security forces have been lost during this militancy period due to the liberty of these type of people who are the absconder of one nation of state and are roaming in J&K state taking benefit of innocent people by false impersonation. In such like circumstances and seeing the age and behaviour the accused Khalid Parvez alias Javed son of Mohammad Ali of Ikhalaspur, district Narobal, Pakistan who has been convicted under section 3 EAO, shall suffer rigorous imprisonment for a period of ten years and shall pay a fine of Rs. 10,000. In default of payment of fine, he shall suffer further rigorous imprisonment for a period one year.

Khalid Parvez who has been convicted under section 3 EAO, shall suffer rigorous imprisonment for a period of ten years and shall pay a fine of Rs 10,000 and in default of payment of fine, he shall suffer further rigorous imprisonment for a period one year. Under section 368 RPC convict shall suffer rigorous imprisonment for a period of ten years and shall pay a fine of Rs 10,000 and in default of payment of fine, he shall suffer further rigorous imprisonment for a period two year. Court clarified that all the sentence shall run-concurrently.

Court also directed that after the completion of sentences the convict may be sent back to his country.
