HC directs SSP Jammu to file status report within one week

JAMMU, Mar 25 (JNF): Division Bench of High Court took serious view of Illegal mining in River Tawi and directed Senior Superintendent of Police (SSP), Jammu to file status report within one week.
In Public Interest Litigations (PILs) filed by Advocates Dewakar Sharma and Ashish Sharma highlighting various issues involving conservation/preservation of River Tawi today Division Bench comprising Justice Alok Aradhe and Justice Tashi Rabstan, Advocate Sheikh Shakeel Ahmed who had earlier been appointed as Court Commissioner in the said PILs informed Division Bench that despite ban imposed by Division Bench in November 2016 on illegal mining in River Tawi is taking place unabated.
Advocate SS Ahmed apprised Division Bench that illegal mining towards Sidhra and Nagrota is going on day and night and local police authorities seem to be hand in glove with mining mafia and even today morning he personally witnessed more than five Tractor Trolleys in River Bed at Sidhra, Jammu. He further submitted that directions of Division Bench are being taken lightly/casually by SSP, Jammu. He further submitted that on number of occasions he has been sending photographs on personal whatsapp of SSP Jammu showing illegal mining in river bed and orders of Division Bench needs to be respected by police authorities.
Division Bench after considering submissions made in public interest by Advocate SS Ahmed in open court expressed its displeasure and asked Senior AAG SS Nanda appearing for state government to convey concern of court to SSP, Jammu. Division Bench also directed Senior AAG SS Nanda to file a status report with regard to the violations highlighted with regard to illegal mining within one week by SSP, Jammu.
Advocate Dewakar Sharma, petitioner in person, also shared the similar concern as projected by Advocate SS Ahmed and sought early listing of the matter and upon this Division Bench directed the Registry to list the instant PILs immediately after one week.
