Court directs IGP to execute warrants against 2 cops

SRINAGAR, Apr 2: A city court has asked the Inspector General of Police (IGP) Kashmir to execute warrants without any delay against two accused cops allegedly involved in shooting a tear smoke shell that had hit Wamiq Farooq, a 7th standard student, on January 31, 2010 resulting into his death. In case of failure, the IGP has been asked to cause his personal appearance before the court in next date of hearing in the matter.
The order issued by the Chief Judicial Magistrate (CJM) Srinagar today reads: “..SSP filed report on warrants issued against accused cops and the same is nothing but repetition of earlier report. The report, on perusal, reflects nothing but delay tactics adopted by police to execute warrants against accused.”
The CJM has said that no plausible and satisfactory explanation has been tendered for non execution of warrants against accused, rather it appears that police intends to provide escape route to the accused persons from court appearance.
“This court is not satisfied with the report filed and so in order to procure attendance of accused persons coercive means are imperatively required to be followed,” the CJM has said in his order.
The court has now directed: “In this backdrop, non bail able warrants of arrest are issued against accused persons and same be sent to IGP Kashmir Zone for getting executed on accuse persons without any delay and in case of failure to do so, IGP shall cause his appearance in court to explain his position as to why he be not proceeded for non compliance of court direction.” The case has now been listed for next hearing on April 16.
Earlier on March 14, the court had termed the report filed by SSP Srinagar “unsatisfactory” and asked the IGP Kashmir to execute the arrest warrants against two accused cops---ASI Abdul Khaliq Sofi and SPO Mohammad Akram without any fail.
In his report filed on behalf of the IGP Kashmir, the SSP Srinagar had said that the accused number one is on an earned leave and the accused number two is undergoing training at Talwara STC and warrants were forwarded to his unit for execution.
While issuing non-bailable arrest warrants against the two accused cops and directing the IGP Kashmir to execute these warrants without any fail under law, the CJM had said that failure to execute warrants would entail coercive means.
It may be recalled that police had earlier submitted a report in April 2013 concluding that the teenager died either by falling from wall of Ghani Memorial stadium or may have died in an explosion caused by tear smoke shell.
Police had claimed to have carried out investigation process as per directions of the court, as part of which the clarification of queries from Forensic Science Laboratory (FSL) Jammu were received and four persons claimed to be witnesses the death of the teenager were examined and their statements recorded.
