Court hears army’s revision plea in Kunan Poshpora rape case

SRINAGAR, Feb 1: The revision petition filed by Army in Kunan Poshpora rape case was listed for final arguments at the Court of District and Sessions Judge, Kupwara.
The army counsel, Karnail Singh argued that the case is a conspiracy against the army and that there are no medical evidences. “This is a pre-planned, politically motivated game against army,” he argued.
He said, “statement of victims are stereotyped and like recorded rotten stereo sounds that play rape all over again” and that victims are incited by some people who were behind the whole case in 1991 and even now.
He argued that the order by magistrate is for fresh investigations and not further investigations and that the magistrate snatched evidence from the investigating officer and handed it over to another officer.
While questioning the capability of the then appointed magistrate, the army counsel argued that the order of June 18th 2013, was against law, arbitrary, capricious and without judicial learning.
He said that the army has remained cooperative and sincere in the investigations and that the perusal of the case after 24 years is exploitation of army by “certain people”.
While terming the investigating officer as “God fearing”, he said that the victims were tutored and were playing ‘the rape card when there was no rape or torture’.
The Public Prosecutor was reluctant to argue and asked the counsel for the victims to argue. The case is now listed for February 8.
