Construction of minister’s house challenged: HC directs status quo

SRINAGAR, Nov 18: Directing for status quo, the High Court today issued notice to government in a petition challenging the construction of residential house by Choudhry Mohammad Ramzan, minister for Consumer Affairs and Public Distribution (CAPD) at Friends Enclave in Humhama, Budgam.
Justice Bansi Lal Bhat, in his order has said: “Issue notice in main petition as also in CMP returnable within four weeks. Requisite steps within one week. In the meanwhile, status quo on spot as it exists today is directed to be maintained till next date of hearing.”
Quoting the petition, the court order has said: “Respondent 10 (Choudhry Mohammad Ramzan) a member of the state cabinet is alleged to have managed permission for raising a double storied residential house on plot numbers C-5 and C-6 Friends Enclave in Humhama, Budgam in league with official respondents.”
It reads: “Allegedly, under the garb of said permission, he is raising construction in clear violation of the sanctioned plan on the aforesaid plots after grabbing the public lane, and green strip reserved for beautification of the colony, which is detrimental to the rights and interests of the inhabitants of the colony including the petitioner.”
The petitioner Dr Ghulam Nabi Yatoo has challenged the construction of residential house of the minister on a plea that the land meant for the beautification has been grabbed by the respondent minister. Pertinently, Mian Abdul Qayoom, president High Court Bar Association (HCBA) has filed the petition on behalf of the Dr Yatoo.
The court has said that petitioner being aggrieved of the acts of commission attributed to respondents, has filed the instant petition seeking appropriate relief.
