SC refuses to postpone Bihar polls

NEW DELHI, Sep 25: The Supreme Court on Friday refused to interfere with the postponement of the Bihar Assembly elections in view of the Covid-19 pandemic and directed the petitioner to better make a representation to the Election Commission.
The petition by one Ajay Kumar came up before a Bench headed by Justice Ashok Bhushan on the day the Election Commission announced the poll schedule. The Court gave liberty to him to withdraw the petition.
The Bench, which included Justices R Subhash Reddy and M R Shah, asked him to approach the Election Commission, but when he sought an order to do so, the Bench flared up: "We can't permit everybody to go to the Election Commission. We can only permit you to withdraw the petition." Incorporating a permission in an order has a different connotation as the SC's approval instead of a person moving the EC himself.
It refused to pass any orders on the petitioner's plea that a similar petition was dismissed earlier also but the ground situation has not improved it to hold the elections.
